FishTownCo App Terms of Service

1. About These Terms

These Terms of Service govern your use of the FishTownCo mobile application and related services.

FishTownCo helps boat owners organise vessel information, crew records, safety equipment, certificates, and documents.

By creating an account or using the app, you agree to these terms. If you do not agree, you should not use the app.

2. Eligibility and Your Account

FishTownCo is intended for users aged 18 and over.

You are responsible for providing accurate account information, keeping your login credentials secure, and maintaining control of devices used to access your account.

You must notify us if you suspect that your account has been accessed without authorisation.

3. Using the App

You may use FishTownCo to manage your own vessel records and other information you are authorised to access.

You agree not to:

Use the app unlawfully or for fraudulent purposes.
Access another person's account or information without permission.
Interfere with the app's security or normal operation.
Attempt to disrupt, damage, or reverse engineer the service except where applicable law permits.
Upload malicious files or information that you are not authorised to share.

We may take reasonable measures to protect the app and its users from misuse.

4. Your Data and Responsibilities

You are responsible for the accuracy and completeness of the information you enter into FishTownCo, including vessel details, crew records, safety equipment information, and document expiry dates.

You must have the necessary permission or lawful basis to enter personal information about other people, including crew members.

You should keep independent copies of important certificates, registrations, safety records, and other critical documents. You remain responsible for meeting applicable maritime, safety, licensing, and regulatory requirements.

FishTownCo is a record-management tool. Unless expressly stated otherwise, it does not replace professional advice, statutory inspections, required certifications, or your own safety checks.

5. Reminders and Notifications

The app may provide reminders based on dates and information you enter.

You are responsible for ensuring that those dates are accurate and that you take appropriate action when a reminder is received.

Notifications may be delayed, disabled, or unavailable because of device settings, network conditions, or technical issues. Do not rely solely on app notifications for critical safety requirements or legal deadlines.

6. Subscriptions and Payments

You need a FishTownCo Pro subscription to use the app. New accounts can try the app free for 7 days first.

Free trial: you can start a 7-day free trial once per FishTownCo account. It is free, needs no payment details, and never turns into a paid subscription by itself. When the 7 days end, choose a plan to keep using the app. Creating extra accounts to get more free trials is not allowed.

Plans and prices: FishTownCo Pro is available as a monthly or a yearly subscription. The current price of each plan, in your local currency, is shown in the app and by Apple or Google before you confirm your purchase. Prices may differ between countries and may change over time.

How subscriptions work:
- Payment is taken from your Apple ID or Google Play account when you confirm the purchase.
- Your subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your account is charged for the renewal within 24 hours before the current period ends.
- If the price of your subscription changes, Apple or Google will tell you before the new price applies, and you can cancel before then.
- You can manage or cancel your subscription at any time in your Apple ID or Google Play account settings. Cancelling stops the next renewal; you keep access until the end of the period you paid for.
- Deleting the app or your FishTownCo account does not cancel your subscription.

If your trial or subscription ends, you cannot use the app until you subscribe. Your records stay saved in your account, and you can still sign in, restore a purchase or delete your account.

Refunds are handled by Apple or Google under their own policies. This does not affect your legal rights as a UK consumer.

7. Availability and Changes

We aim to keep FishTownCo available and functioning reliably, but we cannot guarantee uninterrupted access or that every feature will always be available.

We may update, improve, suspend, or discontinue features when reasonably necessary, including for maintenance, security, technical, or legal reasons.

Where required by applicable law, we will provide notice of material changes.

8. Intellectual Property

The FishTownCo app, its branding, design, software, and original content are owned by FishTownCo or its licensors, except for content belonging to other parties.

These terms give you a limited, personal, non-exclusive, non-transferable right to use the app for its intended purpose. They do not transfer ownership of the app or its intellectual property to you.

You retain the rights you have in the information and files you upload, subject to the permissions necessary to operate the service.

9. Privacy

Our collection and use of personal data are described in the FishTownCo App Privacy Policy.

Please review the Privacy Policy for details about the information we process, our service providers, your privacy rights, and account deletion.

10. Suspension and Account Deletion

You may stop using the app and delete your account through the available account settings.

We may restrict or suspend access where reasonably necessary to protect the service, comply with legal obligations, address misuse, or enforce these terms.

Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.

Account deletion may permanently remove records and uploaded files. You should export or retain any information you need before deleting your account, where export options are available.

11. Disclaimers and Liability

FishTownCo is provided as a record-management service. We aim to make it useful and reliable, but we do not guarantee that the app will be error-free, continuously available, or suitable for every individual requirement.

You remain responsible for vessel operation, crew safety, maintenance, compliance, and the accuracy of your records.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including any rights you may have as a consumer under applicable law.

Any other limitation of liability must be interpreted subject to applicable law.
